This Privacy Policy explains how ABOVO.JOBS Inc. ("ABOVO," "we," "us," or "our") collects, uses, shares, and protects personal information when you use the ABOVO website at abovo.jobs and its subdomains, the ABOVO mobile applications, and related services (collectively, the "Service"). This Privacy Policy is incorporated into our Terms of Service.

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

In a nutshell. We collect what we need to match U.S.-based Job Seekers with U.S.-based Employers. We do not sell personal information. We do not knowingly collect data from anyone under 18. You can update your profile or delete your account at any time. If you live in California, you have additional rights described in Section 10.

1. Scope and Definitions

This Privacy Policy applies to personal information we collect through the Service. It does not apply to (a) information collected by third parties through their own websites, apps, or services, including payment processors and analytics providers linked from or integrated with the Service, or (b) information collected outside the Service (for example, in employer offices or during in-person interviews).

Capitalized terms not defined here have the meanings given in our Terms of Service.

2. Information We Collect

2.1 Information You Provide

When you create an Account or otherwise use the Service, you may provide:

Job Seeker account data: email address, first name, age (year of birth), profile photograph, the type of work you are seeking, the location where you wish to work, optional self-introduction video, optional social-media link, and any in-app responses you give to profile-building prompts.

Employer account data: business name, U.S. tax identification number or business registration number, business address, contact-person name and email, payment information (handled directly by our payment processor — we do not store full card data), and Listing content.

Communications: in-app messages, voice, and video communications you exchange with other Users; messages you send to ABOVO support; and content of any reports you submit.

User-generated content: profile photographs, introduction videos, and other content you upload.

2.2 Information We Collect Automatically

When you use the Service, we automatically collect:

Device and connection information: device type, operating system, browser type, language, IP address, mobile carrier, time zone, screen size, and similar technical identifiers.

Usage information: pages and screens viewed, swipes and other interactions with Listings, in-app responses, session duration, referring URLs, and timestamps.

Approximate location: derived from your IP address. We do not collect precise GPS location.

2.3 Information We Receive from Third Parties

We may receive information from:

Stripe, Inc. — our payment processor — confirms payment status and provides transaction metadata; we do not receive full card numbers from Stripe.

Identity- and email-verification services, where used, to help us confirm that an Account is genuine.

Other Users — for example, an Employer may include your first name and Application in correspondence with us, or report your Account.

3. How We Use Information

We use personal information to:

Provide the Service — create and maintain Accounts, present Listings to Job Seekers, deliver Applications to Employers, process Token purchases, enable in-app communications, and operate the Matching Engine.

Improve the Service — analyze usage patterns to refine the Matching Engine and other features, debug issues, develop new features, and conduct internal research. Where we use personal information for product-improvement purposes, we use aggregated or de-identified data wherever practical.

Communicate with you — send transactional notifications (account confirmations, payment receipts, Listing status, Application activity, policy changes) and, with your consent or as permitted by law, marketing communications. You can opt out of marketing emails at any time.

Maintain safety and integrity — detect, investigate, and prevent fraud, spam, harassment, abuse, and violations of our Terms of Service or applicable law; enforce our agreements.

Comply with legal obligations — meet our obligations under applicable law, respond to subpoenas, court orders, and other legal process, and protect our rights and the rights of others.

4. Automated Processing, the Matching Engine, and AI Features

4.1 The Matching Engine. We use a proprietary ranking algorithm (the "Matching Engine") to determine the order in which Listings appear in a Job Seeker's discovery feed. The Matching Engine considers signals such as your declared preferences (work type, location), prior in-app behavior (which Listings you swiped right or left on, which prompts you responded to), and Listing attributes. The Matching Engine ranks Listings for relevance. It does not make screening, hiring, or other employment decisions about any individual Job Seeker.

4.2 AI-Generated Listing Drafts. Employers may use an AI-powered tool that drafts Listing copy from a short free-text description and location. This tool uses third-party large-language-model services (currently provided by Google). The Employer reviews and is responsible for the content of any Listing it publishes. The free-text input and location are transmitted to the third-party AI provider for the limited purpose of generating draft text; we do not transmit Job Seeker personal information to the AI provider for this purpose.

4.3 No Automated Employment Decision Tool ("AEDT"). ABOVO does not use the Matching Engine, the AI drafting tool, or any other Service feature to substantially assist or replace any hiring or screening decision about any individual Job Seeker. All hiring and screening decisions are made by Employers through manual review and in-app interaction. Where applicable law — including New York City Local Law 144 of 2021 — requires bias audit, candidate notice, or other compliance, ABOVO will comply or will require Employers to comply, as applicable.

5. How We Share Information

5.1 With Other Users

The Service is designed to connect Employers and Job Seekers. As a result:

Job Seekers: when you express interest in a Listing, we share with the relevant Employer your first name, profile photograph, location, age range (not exact birth date), responses you have provided to in-app prompts, and any messages you send through the Service. Additional identifying information (last name, contact details) is shared with the Employer only as the recruiting workflow progresses, including following an exchanged and accepted Offer.

Employers: your Listing content is publicly visible to Job Seekers within the Service. Your business name and Listing-level information are not treated as confidential.

5.2 With Service Providers

We share personal information with vendors that help us operate the Service, under written contracts that limit their use of the information. Our principal service providers are:

Stripe, Inc. — payment processing.

Google LLC — large-language-model AI services for Listing drafting (Google Gemini API) and usage analytics (Google Analytics).

Cloud infrastructure providers — hosting, storage, and content delivery.

Email-delivery providers — transactional and marketing email.

Customer-support and ticketing platforms — to manage support inquiries.

5.3 For Legal and Safety Reasons

We may disclose personal information when we believe in good faith that disclosure is necessary to (a) comply with applicable law, regulation, legal process, or governmental request; (b) enforce our Terms of Service; (c) detect, prevent, or address fraud, security, or technical issues; or (d) protect the rights, property, or safety of ABOVO, our Users, or the public.

5.4 In Business Transactions

If ABOVO is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of its assets, personal information may be transferred to or shared with the successor entity, subject to the commitments in this Privacy Policy or a successor policy of substantially equivalent protection.

5.5 We Do Not Sell Personal Information

ABOVO does not sell personal information in exchange for monetary consideration. We also do not "share" personal information for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act, as amended.

6. Data Retention

We retain personal information for as long as your Account is active and for a reasonable period after Account closure for legal, audit, dispute-resolution, fraud-prevention, and business purposes. Specifically:

Account data: retained while the Account is active.

Closed-account data: retained for up to seven (7) years after closure for legal-compliance and audit purposes, after which it is deleted or de-identified.

Communications (in-app messages): retained for the longer of (a) the life of the Account or (b) two (2) years from the date of the communication.

Payment records: retained for seven (7) years as required by U.S. tax and accounting laws.

Server logs and security records: retained for up to twenty-four (24) months.

7. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encryption of data in transit using TLS, encryption at rest, access controls, logging, and routine security review. No method of transmission or storage is 100% secure, however, and we cannot guarantee absolute security. You are responsible for keeping your Account credentials confidential.

8. Your Choices

8.1 Account and Profile Information

You can view and update most of your profile information from your Account settings. You may delete your Account at any time through the Service. Following deletion, we retain personal information for the periods described in Section 6.

8.2 Marketing Communications

You may opt out of marketing emails by using the unsubscribe link included in every marketing email, or by adjusting notification settings in your Account. Opting out of marketing does not affect transactional communications you receive while your Account is active.

8.3 Cookies and Tracking

You can manage cookies through your browser settings and our Cookie Policy. Some browsers transmit a "Do Not Track" signal; ABOVO does not currently respond to Do Not Track signals because no industry-wide standard exists.

9. California Residents

This Section 9 supplements the rest of this Privacy Policy and applies to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA").

9.1 Categories of Personal Information Collected

In the past twelve months, we have collected the following categories of personal information about California residents:

Identifiers (e.g., name, email, IP address, user identifiers).

Customer records (e.g., contact information, payment information processed by our payment processor).

Characteristics of protected classifications under California or federal law (e.g., age).

Commercial information (e.g., Token purchases, transaction history).

Internet activity (e.g., browsing and Service usage information).

Geolocation data (approximate, IP-derived).

Audio, electronic, visual information (e.g., profile photographs, optional introduction videos).

Professional information (e.g., work preferences and in-app responses).

Inferences drawn from the above (e.g., relevance signals used by the Matching Engine).

9.2 Sources and Purposes

We collect this information from you, from your device, and from service providers as described in Sections 2 and 5. We use it for the purposes described in Section 3.

9.3 Your California Rights

Subject to certain exceptions, California residents have the right to:

Know what categories of personal information we have collected, the sources of that information, the purposes for which we use it, and the categories of third parties with whom we share it.

Access the specific pieces of personal information we have collected about you.

Correct inaccurate personal information.

Delete personal information, subject to certain exceptions (such as completing a transaction, security, or legal compliance).

Opt out of the sale or sharing of personal information. ABOVO does not sell or share personal information as those terms are defined under the CCPA.

Limit use of sensitive personal information. ABOVO does not use sensitive personal information for purposes that would trigger this right.

Not be discriminated against for exercising these rights.

9.4 How to Submit a Request

To submit a request, contact us at privacy@abovo.jobs or by mail at ABOVO.JOBS Inc., Attn: Privacy, 405 Lexington Avenue, Floor 9, New York, NY 10174. We will verify your identity before processing the request, typically by confirming information already on file. You may use an authorized agent to submit a request on your behalf, in which case we will require written proof of authorization and may require you to verify your identity directly with us.

We will respond to verifiable requests within forty-five (45) days, with one extension of up to forty-five (45) additional days where reasonably necessary.

10. Children

The Service is intended for adults. We do not knowingly collect personal information from anyone under eighteen (18) years of age. If we learn that we have collected personal information from a person under 18, we will promptly delete that information and terminate the Account. If you believe we may have collected information about a person under 18, please contact us at privacy@abovo.jobs.

11. Geographic Scope and International Users

The Service is intended for users physically located in the United States, and all personal information is processed and stored in the United States. If you access the Service from outside the United States, you understand and consent to the transfer of your information to the United States, which may not provide the same level of data-protection rights as your home jurisdiction.

12. Third-Party Links and Services

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice by email to your Account email address and through an in-app notice, at least thirty (30) days before the changes take effect. Non-material updates may take effect immediately. The "Last Updated" date at the top of this policy indicates when it was last revised.
